Terms of Service
Last Updated: October 12, 2026
1. About These Terms
These terms govern your use of Area 13, the online store for construction and building materials at areathirteen.com (the "Platform"), and every order and quote you place through it.
The Platform is operated by AREA 13 DEVELOPMENT Company For Trading (شركة آريا 13 ديفيلوبمينت للتجارة), a single-person limited liability company registered in the Kingdom of Saudi Arabia — Commercial Registration No. 7055365667, VAT No. 315086005800003 — with its registered address at Building 4176, Al Sulmaniyah 57 St, Al Salmaniyah Dist., Additional No. 6631, Ad Diriyah 13717, Kingdom of Saudi Arabia ("Area 13", "we", "us", "our").
By creating an account, placing an order, or accepting a quote you agree to these terms. They are an electronic contract with legal effect under the Saudi Electronic Transactions Law. If you do not agree, please do not use the Platform.
Our Privacy Policy, Cookie Policy, Shipping Policy, and Returns and Refunds Policy form part of these terms. If they conflict with these terms on a specific topic, the policy dedicated to that topic applies.
2. Definitions
- Buyer, you: the person or business that uses the Platform to buy.
- Consumer: a Buyer who is a natural person buying for purposes outside their trade, business, or profession.
- Business Buyer: a Buyer who buys in the course of a trade, business, or profession, including contractors and companies.
- Supplier: an independent company that supplies goods to Area 13 for resale on the Platform. Suppliers are shown on product pages and quotes so you know where goods come from; they are not a party to your purchase.
- Order: a purchase of goods at the prices shown on the Platform.
- Quote: a price offer for made-to-order or volume goods issued through the Platform in answer to your request for quotation ("RFQ").
- Goods: the products described in an Order or Quote.
3. Area 13 Is the Seller
Area 13 is the seller of every Order and every Quote. When you buy, your contract of sale is with Area 13, and Area 13 is responsible to you for delivering the goods, for their quality and conformity with their description, for returns and refunds, and for handling your complaints.
Area 13 buys the goods it sells from its Suppliers. A Supplier may prepare, pack, or dispatch goods on Area 13's behalf, and may answer your questions in the quote conversation, but it does so as Area 13's supplier. Nothing a Supplier says changes your contract unless Area 13 confirms it on the Platform. You do not pay Suppliers and must not pay them directly.
The design, cost estimation, and contracting services shown under Services on the Platform are different: Area 13 introduces you to independent partner professionals, who perform that work outside the Platform. The scope, price, timeline, any warranty, and the licences and insurance the work requires are agreed between you and the partner directly, and the partner is responsible for them. Those services are not Orders or Quotes, and these Terms' provisions on Orders, returns, and refunds do not apply to them.
4. Your Account
- You must be at least 18 years old and have legal capacity to contract to open an account or place an order.
- If you buy for a business, you confirm that you are authorised to bind it, and the business is the Buyer.
- Keep your account details accurate and your password and verification codes secret. You are responsible for activity on your account; tell us straight away at support@areathirteen.com if you think someone else has used it.
- Some actions require you to verify your email address or phone number first.
- One person or business may not open accounts to avoid a suspension or a limit we have applied.
5. Prices, Currency, Fees, and Tax
5.1 Currency
Prices are set and charged in US Dollars (USD), which is the currency of every Order and of our accounts. Where you choose to display prices in Saudi Riyals (SAR), the SAR figure is a conversion at the rate shown on the Platform and is for your reference. Card payments are charged in USD; your card issuer may apply its own exchange rate or foreign-transaction fee. For a bank transfer, the Order shows the exact amount and currency to send.
5.2 What the total includes
Before you pay, checkout shows every amount that makes up the total: the goods, delivery, any import charges for imported goods, the Service fee or VAT described below, and, where it applies, the online payment processing fee for card payments. The total shown at checkout is the total you pay. Nothing further is collected on delivery.
5.3 VAT and the Service fee
Area 13 is registered for Value Added Tax with the Zakat, Tax and Customs Authority (ZATCA) under VAT No. 315086005800003, with effect from 1 November 2026.
- Before 1 November 2026 Area 13 does not charge VAT. Orders show a separate line called Service fee. The Service fee is Area 13's own charge for its service as seller; it is not a tax and is not paid to any authority. For imported goods, the import VAT Area 13 pays to customs at the border is shown as a separate cost line; it is recovery of a cost Area 13 has paid, not VAT charged by Area 13.
- From 1 November 2026 VAT is charged at the statutory rate (currently 15%) on the goods, on domestic delivery, and on the online payment processing fee, and the Service fee no longer applies.
Which of the two applies to an amount is decided by its date of supply under the VAT Law: the date the goods are delivered, or the date Area 13 receives the payment if that comes first. An Order is paid before it ships, so it is treated by the date Area 13 receives the payment; a bank transfer counts from the date it is credited to Area 13's account. Where a Quote is paid in two parts, the deposit is treated by the date it is received, and the balance by the date the goods are delivered or the date the balance is received, whichever is earlier. An amount whose date of supply falls before 1 November 2026 carries the Service fee, and one whose date of supply falls on or after that date carries VAT. The Service fee is calculated at the same rate and on the same amounts as VAT, so the change of regime does not increase the total agreed for an Order or Quote you have already placed.
5.4 Invoices
Every payment is documented when Area 13 receives it, and the documents are available from the Order page.
- For payments received before 1 November 2026 you receive an invoice that is not a tax invoice and does not show VAT; it shows the Service fee.
- For payments received from 1 November 2026 Area 13 issues electronic tax invoices that comply with ZATCA's e-invoicing (FATOORA) requirements: a simplified tax invoice for Consumers and, for a Business Buyer that gives us its VAT number and national address, a tax invoice in its name. A Quote deposit received from that date is documented by a prepayment tax invoice, and the final tax invoice for the balance deducts it.
- Every refund or price reduction is documented by a credit note against the invoice for the payment it reverses: a tax credit note where that payment was invoiced with VAT, and a plain credit note otherwise. The credit note is dated when the refund is sent.
You are responsible for the accuracy of the business details you give us for a tax invoice.
5.5 Pricing errors
We work to keep prices and descriptions accurate. If a product is listed at an obviously wrong price, we may decline or cancel the Order before dispatch and refund everything you paid in full; we will tell you why.
6. Orders and How the Contract Is Formed
- You choose goods, a delivery address, and a payment method, and review the totals at checkout.
- When you submit the Order you make an offer to buy those goods at those prices.
- The contract of sale is formed when Area 13 confirms the Order after receiving your payment — when your card payment succeeds or, for a bank transfer, when we have received and verified the transfer. We send a confirmation by email and show it on your order page.
An unpaid Order is held only for a limited time: about 60 minutes for a card payment and 72 hours for a bank transfer. If payment is not received in that time the Order expires and the goods are released.
We may decline an Order before it is confirmed — for example if goods are unavailable, the price was listed in error, delivery is not possible to your address, or we suspect fraud — and we refund anything you paid in full. An Order may arrive in several shipments.
7. Quotes (RFQ) and Made-to-Order Goods
7.1 Requesting and receiving a Quote
You can request a quote for volume, custom, or made-to-order goods. A Supplier prepares the commercial details, and Area 13 issues the Quote to you as the seller. A Quote states the goods, specifications, quantity, price, delivery charges, lead time, any deposit, and the date until which it is valid. A Quote that has expired can no longer be accepted.
7.2 Acceptance
A Quote becomes a binding contract between you and Area 13 when you accept it on the Platform and pay the amount due on acceptance (the deposit, or the full price where no deposit applies), and Area 13 confirms it. The lead time stated in the Quote is the agreed delivery period for that contract.
7.3 Deposit and balance
Where a Quote requires a deposit, the deposit is charged on acceptance and the balance becomes payable once the goods have been delivered to you. You must pay the balance promptly when the Platform asks for it. Ownership of goods bought under a deposit Quote passes to you when the balance is paid in full.
7.4 Made-to-order goods
Goods made, cut, mixed, or adapted to your specifications cannot be withdrawn from or returned for a change of mind once the Quote is accepted; this is a statutory exception to the right of withdrawal. Cancellation of a confirmed Quote is reviewed by our team. Before production starts, the deposit is refunded in full. After production has started, we approve a cancellation, with a full refund of the deposit, where the work can still be stopped without loss; otherwise we decline it and give our reasons, and the Quote continues as agreed. If Area 13 cannot perform the Quote, you are refunded everything you paid. Your rights for goods that are defective or do not match the agreed specification are unaffected.
7.5 Quote conversation rules
The quote conversation exists so you can clarify specifications with the Supplier. Within it, and in all dealings that arise from the Platform:
- Keep all communication and every deal on the Platform. Do not share or ask for phone numbers, email addresses, bank details, or other off-Platform contact details, and do not agree to buy the same goods from the Supplier outside the Platform.
- A message in the conversation does not change the price, specification, or terms of a Quote. Only a Quote issued or updated by Area 13 on the Platform does.
- We may review conversations to keep them safe, to enforce these rules, and to resolve disputes, as described in our Privacy Policy.
Breaching these rules may lead us to cancel the Quote and to suspend the account.
8. Payment
You can pay by card, through our licensed payment processor, or by bank transfer to an Area 13 bank account named on the Order.
- Card: we never see or store your full card number. Where an online payment processing fee applies to card payments, it is shown as its own line before you choose how to pay. A bank transfer carries no such fee.
- Bank transfer: send the exact amount, in the currency shown, with the reference shown on the Order. The Order is confirmed only once our team has matched and verified the transfer. Transfers that cannot be matched are held and returned to their sender after verification.
All amounts must be paid in full; we do not accept payment through a Supplier or any third party not named on the Order.
9. Delivery
We deliver to addresses inside the Kingdom of Saudi Arabia only. Delivery is described in our Shipping Policy. In summary:
- An estimated delivery time is shown before you order where one is available; for a Quote, the lead time in the Quote applies.
- If delivery is delayed by more than 15 days beyond the agreed delivery date, and the delay is not caused by force majeure, you may cancel the affected goods and are refunded what you paid for them, including the delivery and import charges for those goods, as set out in the Returns and Refunds Policy, in addition to any other right the law gives you.
- Imported goods: for goods supplied from outside the Kingdom, Area 13 is the importer of record. We arrange international freight and customs clearance and pay the duties and import charges, which are already included in the price you paid at checkout.
10. Risk, Ownership, and Inspection
- Risk of loss or damage passes to you when the goods are delivered to the address on the Order and handed to you or to a person accepting delivery for you.
- Ownership passes to you on delivery once the price is paid in full, and for deposit Quotes when the balance is paid.
- Inspection: please check the goods when they arrive. When your shipment is out for delivery you receive a delivery code; give it to the courier only once you have received the goods. Using the code confirms that the goods were handed over. It does not waive your rights for damage, shortages, or defects found afterwards.
- To help us act quickly, report visible damage, missing items, or wrong items within 48 hours of delivery, with photos. Reporting later does not remove your statutory rights.
11. Cancellations, Withdrawal, Returns, and Refunds
Cancelling an Order, returning goods, and refunds are governed by our Returns and Refunds Policy. In summary:
- A Consumer may withdraw from a purchase within 7 days of receiving the goods, as the Saudi E-Commerce Law provides, subject to its statutory exceptions. Our return windows are longer than that: 14 days from delivery for goods supplied from within the Kingdom and 30 days for imported goods.
- The statutory exceptions cover goods made or adapted to your specifications and goods that deteriorate quickly, and the right applies only to unused goods, so goods that have been mixed, cut, installed, or otherwise used cannot be withdrawn from for a change of mind. Opening the packaging to inspect goods does not, by itself, remove the right.
- Refunds are made to the original payment method, or by bank transfer to an account in the Buyer's name.
12. Quality and Warranty
- Area 13 warrants that the goods it sells match their description and the agreed specification and are free from defects when delivered. If they are not, you may ask us to repair or replace them or to refund them, as Saudi law provides.
- Where a manufacturer's warranty is stated on the product page or in the Quote, it applies in addition to our responsibility to you, and we help you claim under it.
- This warranty does not cover normal wear, damage caused by incorrect storage, handling, installation, or use after delivery, or goods used beyond the manufacturer's stated limits.
- Product information, specifications, and data sheets are provided to describe the goods. Choosing products that suit your design, engineering, building-code, and safety requirements is the responsibility of the Buyer and its professional advisers.
13. Business Buyers
If you are a Business Buyer:
- The statutory consumer right of withdrawal does not apply to you. Our voluntary return windows apply as set out in the Returns and Refunds Policy.
- You must give accurate business details (legal name, Commercial Registration number, VAT number, and national address) if you want a tax invoice in your company's name.
- Area 13's total liability to you arising from an Order or Quote is limited to the total price you paid for that Order or Quote, and Area 13 is not liable for loss of profit, loss of business, project delay or delay penalties, or any indirect or consequential loss.
- These limits do not apply to liability arising from fraud, wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot be limited under Saudi law.
14. Our Responsibility
We provide the Platform with reasonable care and skill, but it may occasionally be unavailable for maintenance or for reasons outside our control. To the extent Saudi law permits, Area 13 is not liable for indirect or consequential losses. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury, or any right a Consumer has under the E-Commerce Law or other consumer-protection rules that cannot be waived.
15. Acceptable Use
You must not:
- Use the Platform for any purpose that breaks the laws of the Kingdom of Saudi Arabia, including the Anti-Cyber Crime Law
- Give false information, impersonate anyone, or place Orders or accept Quotes you do not intend to pay for
- Interfere with the Platform's security or operation, try to gain unauthorised access, or upload malicious code
- Scrape, copy, or reuse the Platform's content, prices, or data by automated means without our written permission
- Deal with a Supplier outside the Platform for goods you found on it, or try to move payment off the Platform
- Infringe anyone's intellectual property, privacy, or reputation, or post unlawful, abusive, or misleading content
16. Intellectual Property
The Area 13 name and logo, the Platform's design and software, and the content we create belong to Area 13 or its licensors. Product names, images, and descriptions are supplied by Suppliers and used under licence. You may use the Platform for your own purchasing; any other use requires our written permission.
17. Reviews and Content You Submit
Reviews, questions, and messages must be honest, relate to your own experience, and must not be unlawful, abusive, misleading, or promotional. We may check reviews before or after publication, including with automated moderation tools, and remove content that breaks these rules. We do not edit a review to change its meaning, and we do not offer rewards for positive reviews. By posting content you grant Area 13 a non-exclusive, royalty-free licence to display it on the Platform and in our communications about the products concerned.
18. Suspension and Closure
We may restrict, suspend, or close an account that breaches these terms, is used fraudulently, or puts other users or the Platform at risk. Where the law and the circumstances allow, we tell you why and give you a chance to respond. Closing an account does not cancel confirmed Orders or Quotes or the obligations attached to them. You may close your account at any time by contacting us.
19. Force Majeure
Neither party is responsible for a delay or failure caused by events beyond its reasonable control, such as natural disasters, severe weather, epidemics, war, civil unrest, government action, customs measures, port closures, or failure of public networks. The affected party will tell the other promptly and do what it reasonably can to limit the effects. If an event of this kind prevents delivery for more than 30 days, either party may cancel the affected goods, and you are refunded what you paid for them.
20. Notices
We send notices to the email address and phone number on your account, and they are treated as received when sent, unless we learn they were not delivered. Notices to us go to legal@areathirteen.com or to our registered address in Section 1. Notices and records in electronic form are valid evidence between us, as the Electronic Transactions Law provides.
21. Complaints and Disputes
- Complaints: contact us at support@areathirteen.com or +966 56 04 100 13, with your order number. We acknowledge a complaint within 2 business days and aim to resolve it within 14 days.
- Consumers may also complain to the Ministry of Commerce through its official consumer-complaint channels. Complaints about personal data may be made to the Saudi Data and Artificial Intelligence Authority (SDAIA).
- Disputes: we will first try to settle any dispute amicably. If a dispute is not settled within 30 days of written notice, it will be decided by the competent courts in the city of Riyadh, Kingdom of Saudi Arabia. This does not take away any right a Consumer has under Saudi law to bring a claim before another competent court or authority.
22. Governing Law and Language
These terms, and every Order and Quote, are governed by the laws of the Kingdom of Saudi Arabia. These terms are published in Arabic and English. If the two versions differ, the Arabic version prevails.
23. Changes to These Terms
We may update these terms; the date at the top shows the current version. The terms in force when you placed an Order or accepted a Quote apply to it, so an update never changes an Order you have already placed.
When we update these terms and you have an account, we show you a notice on the Platform asking you to review and accept the updated terms. You can keep browsing in the meantime, but you must accept them before you place your next Order or pay for a Quote, and we record when you accepted which version. If a change materially affects you, we tell you before it takes effect. If you do not wish to accept the updated terms, you may close your account; Orders already placed continue under the terms that applied to them.
24. General
If any provision of these terms is found invalid, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; Area 13 may transfer its rights and obligations to a successor entity that continues the Platform, provided your rights are not reduced.
